Copyright, License, Use, and Liability Contract

As is customary with computer products, it is necessary for us to have an agreement with each family licensed to use this curriculum. The essence of the agreement is that the contract will be honored, and that the producer's liability is limited to the purchase price of the product. This math curriculum product is unusual because we encourage each family to make printed copies of its content for their own use. On a case-by-case basis, we also sometimes authorize extensive use outside the immediate family. You are welcome to write to us about this possibility.

The use of these CDs (the word CDs shall mean any CD sold by Entrewave and the Arnold Jagt Family) constitutes a contract between the user and Entrewave and the Arnold Jagt family of Howell, Michigan, USA.  That contract permits the user to utilize the materials on screen and to print one copy of the materials for his own use.  Where the user is a single family, the family may print up to four copies of the materials specifically for the use of family members.  If the math curriculum is sold to another user the printed materials must be transferred along with the CDs. Transfer of the CDs does not confer the right to print more copies than would be printed by a single user.

All of the images, files, concepts, ideas, and computer programs in the CDs are similarly protected by this contract and may not be utilized by other parties in any other way than as an end user as described above.

Other uses should be limited to that which is reasonable and proper. Obviously, we do not want to prevent your loaning copies of books and other materials to your friends and acquaintances and others outside your immediate family. If they make extensive use of the math curriculum, then they should consider purchasing their own license.

Written below are the legal details of this agreement. Please read this document. We apologize for its legalistic wording. It is adapted from a standard legal text in widespread use. You should not install this product without reading this document, since the installation constitutes agreement on your part to this contract.

Introduction

The installation and use of this product indicates your understanding and acceptance of the following terms and conditions. This license shall supersede any verbal, or prior verbal or written, statement or agreement to the contrary.

If you do not understand or accept these terms, or your local regulations prohibit "after sale" license agreements or limited disclaimers, you must not use this product. Copyright laws supersede all local regulations.

Copyright

This product (in whole or in part, including all files, data, documentation, and digital and printed copies made from the product,  from here on referred to as "Product") is © Copyright 2003 by Entrewave and the Arnold Jagt family of Howell, Michigan, USA (from here on referred to as "the publishers"), all rights reserved, and is protected by United States copyright laws, international treaties and all other applicable national or international laws. With the exception of materials printed for use by the licensed family, this product may not, in whole or in part, be copied, photocopied, translated, or reduced to any electronic medium or machine readable form, without prior consent in writing, from the publishers and according to all applicable laws. The sole owners of this product are the publishers.

Liability disclaimer

This product and/or license is provided exclusively by the publishers on an "as is" basis,  without any representation or warranty of any kind, either express or implied, including without limitation any representations or endorsements regarding the use of, the results of, or performance of the product, its appropriateness, accuracy, reliability, or correctness. The entire risk as to the use of this product is assumed by the user and/or licensee.  The publishers do not assume liability for the use of this product beyond the original purchase price. In no event will the copyright holders be liable for additional direct or indirect damages including any lost profits, lost savings, or other incidental or consequential damages arising from any defects, or the use or inability to use this product, even if the publishers have been advised of the possibility of such damages.

Restrictions

You may not use, copy, modify, translate, or transfer the product or any copy except as expressly defined in this agreement. You may not attempt to unlock or bypass any copy-protection or authentication algorithm utilized by this product. You may not remove or modify any copyright notice, nor any "about" dialog or the method by which it may be invoked.

Operating license

You have the non-exclusive right to use the product only by the licensed family.  Use by groups larger than one family must be approved in writing by the publishers.  Use over a local area network (within the same locale) is permitted provided that the product is used only by the licensed family. Use over a wide area network (outside the same locale) is strictly prohibited under any and all circumstances.

Distribution license

In order to distribute copies or printouts of these materials in accordance to this license, you must have a special distribution agreement with the publishers, as an authorized licensee, and must have submitted a signed copy of this license stating you agree to be bound by its terms and conditions. You may not reproduce or distribute copies of the complete or partial package, any source, interface, or code units, any of the documentation, nor may you supply any means by which your users could create, modify, or incorporate any part of this product in their own products. No distribution contract is assumed unless a signed copy of a special distribution agreement has been returned to, and acknowledged by the publishers.

Back-up and transfer

You may make copies of the software part of the product solely for back-up purposes, as prescribed by United States, and international copyright laws. You must not remove the copyright notice on the back-up copies. You may transfer the product to another party only if the other party agrees to the terms and conditions of this agreement.  If you transfer the product you must at the same time transfer the documentation and back-up copies, or transfer the documentation and destroy the back-up copies. You must not continue to use the product after you have transferred it.

Terms

This license is effective until terminated. You may terminate it by destroying the complete product and all copies thereof. This license will also terminate if you fail to comply with any terms or conditions of this agreement. You agree upon such termination to destroy all copies of the software and of the documentation, or return them to the publishers for disposal.

Other rights and restrictions

All other rights and restrictions not specifically granted in this license are reserved by the publishers. Note: We do not use your presonal information for anything other than completing sales and filling orders.
